NYS Disability Benefits Law


If you have been injured and live in New York State, you might be interested in knowing what the laws are as far as disability benefits are concerned.  Although this article is rather simplistic in nature, it will cover some of the basic nys disability benefits law information that may be of benefit to you.  It is our recommendation that before you do anything, take a look over the benefits package that came from your employer and also contact an attorney if you think that there may be any problems involved.

One of the interesting things about the nys disability benefits law is the fact that it is one of only a few states that allow an individual to collect disability benefits whenever they were injured off of the jobsite.  These benefits are delivered similar to the way that benefits would be delivered an individual was injured on the job.  The employer is required to carry this insurance on the employee and as long as they are working, they will be covered in case an injury happens to take place.  New Jersey, a neighboring state has a similar law in place but Pennsylvania does not.

If you are running a business, or perhaps franchising a business, you may be interested in knowing that you're going to need to cover your employees in case of an injury, regardless of where they happen to be.  There are a lot of different stipulations that go into the nys disability benefits law that you're going to need to be aware of.  For example, this disability may be collected for 26 weeks in any period of a consecutive 52 week time frame.  You are also well within your rights to collect funds from your employees in order to cover the cost of this disability compensation but it is not a requirement for you to do so.

Regardless of whether you are an employee or an employer in New York, you should be aware of the nys disability benefits law, at least on the most basic level.  Although you certainly would hope that you never need to use the small in your behalf, it is there to benefit you and your family members in case you would have to use it.  Similar to any other type of law that is in other states, it is a protection for those who have become disabled.
