Using The Pregnancy Disability Leave Law In Your Behalf


Having a child is one of the most exciting things that can happen in a woman's life but it can also cause of a lot of stress for the family, wondering if your job is going to be there for you whenever you are ready to go back to work.  Although this used to be a sticky situation for many individuals, this is no longer the case thanks to the pregnancy disability leave law that has gone into practice in many states.  Although the laws may vary from state to state, they all have something in similar for the most part.

One of the main things that the pregnancy disability leave law states is the fact that you will be able to leave work for a certain amount of time in order to care for your new child and your job will be available for you whenever you return.  It would be illegal for your employer to fire you or otherwise relieve you of your job and during that time period.  For example, in California and you are allowed to take 12 weeks off of maternity leave under the pregnancy disability leave law and whenever you return to work, you will be able to get her job back without exception.

Another aspect of the pregnancy disability leave law requires that the employer treats the woman who is disabled as a result of her pregnancy as if it was anybody else that was disabled in another way.  This is an excellent way for somebody to be able to continue to provide for their family by having medical leave and not having to worry about whether their job will be available for them whenever they get back.  This type of temporary medical disability can happen for a number of different reasons but the main point is that it will give the woman enough time to be able to take care of her family which would include her new child.

If you need to use the pregnancy disability leave law in your behalf, you are going to need to have proof from your doctor that you are actually disabled as a result of your pregnancy.  This is typically done in written form but it may also be necessary for them to fax documents over to your office in order to verify the fact that you are having problems.  I once knew a receptionist in Denver that was having an issue with pregnancy and she was able to take off work and travel to Massachusetts to be with family while she was healing.
